These Terms of Use (the "Terms") set out the conditions for using the app "Preflop Range Builder" (the "App") provided by Miyajin Product ("we"). By using the App you are taken to have agreed to these Terms.
1. What the App is for
The App is a study and reference tool for building and managing your own poker hand range charts (a 13×13 grid of 169 hands). It does not promote or facilitate gambling or any other unlawful activity. No cards are dealt, there is no gameplay, and there is no facility to wager money or to settle winnings.
A range chart you build records your own thinking. We take no part in whether it is sound, nor in the outcome of anything you do on the basis of it.
2. Who may use it
- You are responsible for your own use of the App and must comply with the laws that apply to you.
- The App is not intended for children under 13. Minors should use it with the consent of a parent or guardian.
- You must not use the App where local law restricts it.
3. Your data
- The range charts and other data you create are stored on your device. See the Privacy Policy for detail.
- The App has no cloud sync. Backing up your data is your responsibility, and we are not liable for data lost through device failure, loss, OS updates or deleting the App.
4. Price
- The App is free. There are no in-app purchases of any kind, one-off or subscription.
- Some capacity is unlocked by watching a video ad: creating your third or later range chart requires watching one. The first two need no ad.
- Watching an ad unlocks only that capacity. No money or other consideration is paid to you.
5. Advertising
- To keep the App free, it shows third-party advertising (Google AdMob and similar).
- Advertising providers may collect advertising identifiers and similar information. See the Privacy Policy.
- Depending on ad availability and your connection, a video ad may not be ready. When that happens the capacity in section 4.2 may be temporarily unavailable.
6. What you must not do
You must not copy, modify or reverse-engineer the App, use it unlawfully or against public order, or infringe our rights or those of anyone else.
7. Intellectual property
Rights in the App and its software, design and trade marks belong to us or to their rightful owners. The content of the range charts you create belongs to you.
8. Disclaimers
- We make no warranty, express or implied, as to the accuracy, completeness, usefulness or fitness for any particular purpose of the App, its calculations or its data.
- Except in cases of our wilful misconduct or gross negligence, we are not liable for any loss arising from your use of, or inability to use, the App.
9. Changes to the App
We may change, suspend or discontinue the App without prior notice.
10. Changes to these Terms
We may update these Terms as needed. Continuing to use the App after a change means you accept the updated Terms.
11. Governing law and jurisdiction
These Terms are governed by the laws of Japan. The Osaka District Court shall have exclusive jurisdiction at first instance over any dispute relating to the App.
